1. Who we are
Flogen (“we,” “us”) is operated by [[LEGAL ENTITY — TO BE COMPLETED: company legal name]], registered at [[LEGAL ENTITY — TO BE COMPLETED: registered address]] under company / licence number [[LEGAL ENTITY — TO BE COMPLETED: company registration or licence number]]. We operate the Flogen platform: a multi-tenant AI creative workspace that lets teams run meetings with AI agents, generate images, video, voice, and music, and share the output inside and outside their company. By creating an account you agree to these terms.
2. Accounts and workspaces
Individual users create accounts. Companies create workspaces; admins invite members and manage roles (SUPER_ADMIN, ADMIN, MEMBER). You’re responsible for keeping credentials private and for activity on your account and workspace. We may suspend or delete accounts used to abuse the service, spam others, or violate these terms.
3. Acceptable use
Don’t use Flogen to generate child sexual abuse material, non-consensual intimate imagery, harassment, targeted fraud, election disinformation, malware, or content that infringes a third party’s rights. Don’t reverse-engineer model weights or scrape the service. Agents run on paid upstream APIs — don’t try to use Flogen to extract provider credits or bypass rate limits.
4. Credits, plans, and billing
Most generation actions consume credits from your company’s pool (or your personal pool if no company is attached). 1 credit ≈ $0.01 USD. Plans differ in monthly allotment and seat limits. Credits are non-refundable except where required by law. Credits do not expire. Unused credits roll forward indefinitely — there is no expiry window and no clawback of unspent credits, on any plan or credit pack. If we ever propose introducing an expiry policy, it will apply only to credits granted after the change and we will notify workspace admins before it takes effect. Platform admins can top up mid-cycle. Failed generations are refunded to the pool automatically.
5. Your content
Prompts you submit, assets you upload (references, brand materials), and outputs you generate are yours. We store them to deliver the service and to let you retrieve them later. You grant us a limited license to process the content solely to operate Flogen. We will not use your private workspace content to train models without explicit opt-in.
6. Generated content and IP
AI-generated outputs may resemble pre-existing works and may not always be copyrightable in your jurisdiction. You are responsible for clearing rights before commercial use and for complying with the upstream providers’ content policies (plug-in.ai and the model providers it serves, ElevenLabs, Anthropic, etc.). We do not guarantee exclusive rights or indemnify against third-party claims unless covered by your enterprise contract.
7. Availability and changes
We aim for high uptime but don’t commit to a formal SLA unless your plan includes one. We may update features, model providers, and credit pricing with reasonable notice. Breaking changes to the API will be versioned.
8. Termination
You can cancel at any time from your workspace settings. We may terminate accounts that violate these terms or that have been inactive for 12+ months. On termination we delete workspace data within 30 days, except where law or an audit hold requires retention.
9. Liability
Flogen is provided “as is.” To the maximum extent allowed by law, we are not liable for indirect, incidental, or consequential damages. Our total liability in any 12-month period is capped at what you paid us during that period.
10. Governing law and disputes
These terms are governed by the laws of [[LEGAL ENTITY — TO BE COMPLETED: governing law]], without regard to conflict-of-law rules. Any dispute arising out of them is subject to the exclusive jurisdiction of the courts of [[LEGAL ENTITY — TO BE COMPLETED: jurisdiction / competent courts]].
